Conditions of use

The present general conditions of use are concluded between
- Rue du scrap via the website http://www.rueduscrap.com, whose registered office is located 27 bis rue Nicolas Hamant 57950 Montigny Metz, registered with the RCS of Metz under the number 499 663 771, hereafter called "Rue du scrap"
and
- Customers buying via http://www.rueduscrap.comhereafter called "the purchaser".

It should be noted that only the orders placed by the intermediary of the commercial site http://www.rueduscrap.com are taken into account and that Rue of scrap does not receive the customers with his registered office.

1-object
The present conditions of use aim at defining the contractual relations between Rue of scrap and the purchaser and the conditions applicable to any purchase carried out by the means of the commercial site of Rue du scrap http://www.rueduscrap.com. The acquisition of a good or a service through this site implies a general acceptance by the purchaser of these conditions of use.
These conditions of use will prevail on all other general or particular conditions not expressly approved by Rue du scrap.

Rue du scrap reserves the right to be able to modify its conditions of sale constantly. In this case, the applicable conditions will be those in force at the date of the order by the purchaser.


2-characteristics of the products
The offered products are those proposed on the commercial site of Rue du scrap. Each product is accompanied by a description as precise as possible exit of the descriptions provided by our suppliers as well as one or more photographs. The photographs of the catalogue are most faithful possible but cannot ensure a perfect similarity with the offered product, in particular with regard to the colors.


3-Prices
The prices appearing in the catalogue are prices including all taxes in Euros holding account of the VAT applicable to the day of the order. Any change of the rate could be reflected on the price of the products.

Rue du scrap will communicate by electronic mail with the purchaser the various stages of the treatment of its order.
The products remain the property of Rue du scrap until the complete payment of the price.


5-payment
The price is exigible with the order.
All the sums are payable in euros.
To regulate his order, the purchaser can is:

Rue du scrap reserves the right to cancel all in the event of non-payment of any sum which would be due by the purchaser or in the event of incident of payment and this notwithstanding the provisions of these conditions of use.

6-delivery
The carriage costs are as follows:
- 6 Euros for the sendings in Metropolitan France, fresh of port offered beyond 35 Euros of purchase.
- 10 Euros for the sendings towards the DOM TOM
- 15 Euros for the sendings towards Switzerland and Belgium

The deliveries are made with the address indicated during the ordering. The orders are generally dispatched in the 48 H according to the reception of the payment. They are conveyed in Colissimo Suivi under 48h (indicative time of the Post office) for the Metropolitan France.

In the event of variation of the delivery periods (difficulties of routing or periods of holidays in particular), Rue of scrap will inform of it the purchaser by the means of his commercial site and/or by electronic mail.
Rue du scrap will not be able to in no case to be held responsible for an unspecified delay of delivery. In the event of delay of delivery compared to the initially fixed date (one week starting from the date of order), the purchaser will be able to announce it in writing (mail or mall) to Rue of the scrap which will be able to proceed to an investigation near the Post office.
The risks are the responsibility of the purchaser as from the moment when the products left the buildings of Rue du scrap. The purchaser is held to check, in the presence of the agent of the Post office, the state of the goods to the delivery. If the purchaser would have an unspecified doubt about the state of his parcel, it is held to refuse the goods by immediately emitting a report of anomaly near the employee of the Post office (report 170) and to announce these incidents to Rue du scrap by electronic mail in the two wrought days according to the delivery date, while formulating say them complaints or reserves.
Without the respect of this procedure, no complaint of the purchaser will be accepted.


7-availability of the products
Any sale gets along subject to stocks available. If one or more products proved to be inalienable after the ordering of the purchaser, Rue du scrap is committed of to inform it as soon as possible and offering a product of replacement, a delivery differed or a refunding products missing to him within a maximum time 30 days following the date from the order.


8-guarantee and returns
The products offered by Rue du scrap are guaranteed by its suppliers.
For any complaint, you can contact us by mail or electronic mail (contact@rueduscrap.com) In the event of delivery of a product not corresponding to the order (defective or not in conformity), the purchaser must formulate by electronic mail his complaint in the five wrought days according to the delivery date of the order. The complaints must comprise the co-ordinates of the purchaser, the number of order, the references of the product as well as the reason for the complaint. After acceptance of Rue du scrap, the products will have to be turned over by the purchaser within ten day wrought as from the delivery date in their packing of origin and in perfect state.
Rue du scrap is committed to refund by cheque, or exchanging the defective products or corresponding steps to an order within a time lower or equal to 15 days wrought after reception of the return by the purchaser.


9-right of retractation
In accordance with the L121-20 article of the Code of Consumption, the purchaser has a seven working days deadline as from the date of reception to turn over to its expenses, the ordered products, for exchange or refunding.
The products must imperatively be turned over in their packing of origin and a perfect state with the address below: Rue du scrap 27 bis rue Nicolas Hamant 57950 MONTIGNY LES METZ.
In accordance with the L121-20-1 articles in L121-20-7 of the Code of Consumption, Rue du scrap has 30 days a maximum time as from the date of return of the products to refund the purchaser. At the end of 7 days the completion period, no refunding will be possible with the title of the right of retractation.


10-responsibility
Rue du scrap, in the process of sale on line, is held only by one obligation of means; its responsibility could not be committed for a damage resulting from the use of Internet network such as loss of data, intrusion, virus, rupture of the service, or other involuntary problems.


11-Intellectual property
All the elements of the site of StrRue du scrap are and remain the intellectual and exclusive property of Rue du scrap. Nobody is authorized to reproduce, exploit, repeat, or use with some title that it is, even partially, of the elements of the site which they are software, visual or sound.
The photographs of the products remain the property of their respective brands (copyright).

12-data in personal matter
In accordance with the law relating to data processing, the files and freedoms of January 6, 1978, information in personal matter relating to the purchasers could be the subject of an automated treatment. StrRue du scrap reserves the right to collect information on the purchasers including by using cookies, and, if it wishes it, to transmit to trade partners collected information. The purchasers can be opposed to the disclosure of their co-ordinates by announcing it to Rue du scrap.
In the same way, the users have a right of access and of correction of the data with regard to them, in accordance with the law of January 6, 1978.
The automated treatment of information, including the management of addresses email of the users of the site was the one declaration object with the CNIL it (in progress) recorded under the number (in progress).

13-filing, evidence
Rue du scrap will file the purchase orders and the invoices on a reliable and durable support constituting a copy faithful in accordance with the provisions of article 1348 of the Civil code.

14-litigations
